Jacqueline Adhiambo Ongur, a 45-year old HIV-positive Kenyan waitress has won $35,000 in a landmark ruling against her employer for unfair dismissal. She also sued her doctor for revealing her HIV status without her consent.

Mrs Ongur, who had worked for Home Park Caterers for eight years, told the court that when she went to hospital complaining of chest pains and rashes Dr Primus Ochieng tested her for HIV without her consent. Dr Ochieng and the Metropolitan Hospital, in breach of doctor-patient confidentiality, then disclosed her status without her consent to her employer. The former waitress said her employer as well as her colleagues knew about her HIV status before she did. She only found out she was HIV-positive when she went back to the hospital and requested her medical report.

Testing employees for HIV without consent constituted an invasion of privacy and was declared unlawful by the High Court. Disclosing an employee's status to their employer without their consent was also unlawful and the final ruling of the Court said that it was unlawful to end employment on the grounds of a person's HIV status, the first such ruiling in Kenya.

Mrs Ongur said she filed the case to focus attention on the rights of people living with HIV/Aids, who still face immense stigmatisation.

About 2.5 million out of 32 million Kenyans are currently living with HIV/Aids and Mrs Ongurs case is a landslide victory for the fight for the rights of not only Kenyans, but all people living with the virus. The case was labeled particullary challenging as Kenya's constitution does not expressly prohibit discrimination on grounds of HIV.

It's a lesson and a message to employers that people living with HIV and Aids have got rights like any other person to work.

It will bring up many people who have suffered at the hands of their insensitive employers to come out and know that law protects them. 

Despite the continuing discrimination against people living with HIV/Aids we are witnessing steps towards a better future, where rights are equal to all. There is still a long way to go, however Mrs Ongur's victory has given us a boost and will, quoting Mbwavi, inspire others to come out and fight for their rights.

Als sich Franziskus im Spätsommer des Jahres 1224 auf den Berg La Verna zurückzog, wo er seit 1212 eine kleine Felsnische als Einsiedelei benutzte, wurden bei ihm nach Aussage der Biographen Wundmale sichtbar, die die ältesten Quellen als Einprägung der Wundmale Christi deuten. Dies gilt als der erste überlieferte Fall einer Stigmatisation. Als Tag dieses Ereignisses wird in den Biographien der 17. September 1224 angegeben, drei Tage nach dem katholischen Fest der Kreuzerhöhung. Thomas von Celano berichtet, sich auf das Zeugnis des Bruders Leo berufend:

Da sah er in einem Gottesgesicht einen Mann über sich schweben, einem Seraph ähnlich, der sechs Flügel hatte und mit ausgespannten Händen und auseindergelegten Füssen ans Kreuz geheftet war. Zwei Flügel erhoben sich über seinem Haupt, zwei waren zum Fluge ausgespannt, zwei endlich verhüllten den ganzen Körper. Als der selige Diener des Allerhöchsten dies schaute, wurde er von übergrossem Staunen erfüllt, konnte sich aber nicht erklären, was dieses Gesicht bedeuten solle... Während er sich verstandesmässig über das Gesicht nicht klar zu werden vermochte und das Neuartige an ihm stark sein Herz beschäftigte, begannen an seinen Händen und Füssen die Male der Nägel sichbar zu werden in derselben Weise, wie er es kurz zuvor an dem gekreuzigten Mann über sich gesehen hatte.

Seraphime sind Engel mit sechs Flügeln. In der christlichen Tradition gelten sie als Repräsentanten der brennenden Liebe Gottes und nehmen die höchste Position in der Engelshierarchie ein.

La chose est entendue, un gouvernement ne doit jamais se fâcher avec la jeunesse. La droite et la gauche en ont fait l'amère expérience depuis vingt-cinq ans. Mais, dans le même temps, il ne doit pas donner l'impression de trembler devant la première «révolte lycéenne» venue, avec ses slogans simplificateurs et ses mots d'ordre vengeurs. Le gouvernement de François Fillon ne paraît pas sur cette ligne-là, et c'est tant mieux. Un lycéen qui bat le pavé parisien et promet «un printemps chaud» n'a pas toujours raison, loin s'en faut. (mais toujours tort, évidemment)

Xavier Darcos et ses prédécesseurs n'ont pas attendu la fameuse RGPP (réforme générale des politiques publiques) pour constater une vérité d'évidence. Les moyens consacrés au lycée ont augmenté depuis vingt ans, tandis que le nombre d'élèves diminuait. Ce n'est pas faire injure aux socialistes, qui stigmatisent «la régression» dont serait victime l'école, que de leur rappeler le constat brutal dressé il y a dix ans par l'un des leurs : «Il faut dégraisser le mammouth.» Or, depuis la sortie de Claude Allègre, l'embonpoint n'a guère changé. L'Éducation nationale demeure cette énorme machinerie au fonctionnement parfois opaque (serais-ce une secte ?) qui compte 1,2 million de fonctionnaires. Et qui peut dire que le monde entier envie le «modèle» français et s'en inspire ? Malheureusement, si la qualité de l'enseignement dépendait du nombre de professeurs, cela se saurait. Le taux d'encadrement de l'école française est un des plus élevés au monde, avec un enseignant pour 12 élèves, mais, dans tous les classements éducatifs internationaux, le pays perd peu à peu son rang.

Depuis longtemps, l'erreur des «lycéens en colère», et avec eux celle des socialistes, est de s'enfermer dans la seule logique comptable. (ou quand c'est politique, c'est éminemment gauchiste)

La suppression de 8 800 postes, dit l'Unef, c'est «une faute politique». Rien que ça. Mais si «faute politique» il y a eu, n'est-ce pas celle qui a consisté à faire croire aux lycéens durant des années que le «toujours plus» d'enseignants était forcément un gage de qualité ? (en faudrait-il moins ?) La vraie question, c'est l'organisation de l'enseignement, sa refonte, la révision de la politique d'orientation de la seconde à la terminale, le rééquilibrage entre les diverses filières, le réexamen de la politique des options, etc. Bref, la réforme du lycée que Xavier Darcos va entreprendre. La perspective alarme certains syndicats d'enseignants qui, comme toujours dans ces cas-là, ont tendance à jeter les lycéens dans les rues. (admirez un la stigmatisation des syndicats, et le mépris pour une jeunesse pas capable de s'auto-organiser) Car le «jeune en colère» est une proie facile, réceptif aux arguments de ceux qui, comme la FSU ou le Mouvement des jeunes socialistes, poussent les feux de la «mobilisation» contre le gouvernement. Au nom d'arguments dépassés, ils ressortent de vieilles ritournelles, attisent les passions et prennent le risque de débordements.

Des lycéens qui manifestent, un gouvernement qui recule : les Français connaissent le film par cœur depuis un quart de siècle (la chienlit n'est pas loin). Il appartient à Nicolas Sarkozy et François Fillon de changer un scénario qui voit toujours une petite minorité, souvent manipulée, imposer ses vues à une majorité toujours impuissante. (sic)

Et qu'on aille me dire après que ceux qui se disent apolitique ne défendent pas le système et ne sont bien sûr pas politisés.

clipped from www.timesonline.co.uk Franciscan friars at Assisi have confirmed that Mikhail Gorbachev, the last Soviet President, is a Christian after he was seen praying at the tomb of St Francis.Mr Gorbachev has long acknowledged that he was influenced by his grandmother, an Orthodox believer and is a a regular participant in peace conferences in the Umbrian town where St Francis is buried. Vladimir Putin, a former KGB officer, has also turned to Orthodox Christianity and wears a cross round his neck. Mr Gorbachev's parents reportedly kept Orthodox icons hidden behind pictures of Stalin and Lenin, as did the parents of his late wife, Raisa, who were reportedly executed for the offence.

According to the reports, Gorbachev's parents, and his wife's parents, were Orthodox Christians, but the recent reports imply that Mikhail Gorbachev himself is a Roman Catholic. It would be interesting to know whether he actually is.

Francis of Assisi is not an Orthodox saint. He was canonised by the Roman Catholic Church after its schism from Orthodoxy in the 11th century.

Orthodox Christians hold differing views about him. Some admire him, or at least admire certain aspects of his life and work. Others point to other aspects, such as his stigmatistion, and say that no true saint could be stigmatised: such things are a manifestation of prelest (spiritual delusion).

Francis of Assisi was the first Roman Catholic saint to be stigmatised, and his stigmata were commemorated by the Franciscan Order on 17 September, but not by the RC Church as a whole. The attitude of the Roman Catholic Church to stigmatisation has been cautious, though it has not been as opposed to it as the Orthodox Church. Such things did not appear until the 13th century (well after the Great Schism), and then only in the West. It was perhaps a reflection of the increasing emphasis in the West on the sufferings and death of Christ, rather than on the incarnation or resurrection, that people began to be stigmatised, manifesting in their bodies some kind of replication of the wounds of Christ in hands and feet, and sometimes the side.

At best, Orthodox Christians have a qualified admiration for Francis of Assissi, admiring his devotion to evangelical poverty and service to the poor, and his preaching of the gospel, and don't pay much attention to such things as his stigmatisation.

The reports in the Western media about Mikhail Gorbachev being a Christian, with their stress on his devotion to Francis of Assisi, will therefore send mixed signals to Orthodox readers, and some may be tempted to "join the dots"? and fill in the gaps of the reports themselves, and jump to perhaps unwarranted conclusions.

In Russia, immediately after the fall of Bolshevism, the Church was the most trusted institution in society. People did not trust politicians, the army, business, and other institutions, and many felt betrayed by them. One result of this was that politicians were always looking for photo-ops with church leaders in the hope that some of the magic pixie dust of public approval would brush off onto them. This does not mean that every politician who professed to be a Christian was insincere, but there was a very clear ulterior motive.

This does not apply to Gorbachev, who retired from politics after the dissolution of the USSR, and no longer had a political axe to grind. But what he does and what happens to him can provide a grindstone for other people with axes to grind. The relationships between the Patriarchate of Moscow and the Vatican (journalists, please note, it is Patriarchate, not Patriarchy) are rather sensitive, and most of the reports so far could signal an attitude of Vatican one-upmanship, even if the journalists who wrote them did not intend to do so.

En fait, les médecins affirment que la stigmatisation qu’ont pu subir les enfants du crack leur ont causé plus de mal que l’exposition à la drogue elle-même. Maintenant, une nouvelle crainte monte, celle des " bébés du meth ". Mais cette fois, les médecins semblent avoir appris leur leçon. Un groupe de 96 spécialistes de la santé font circuler une déclaration. Les étiquettes telles que " ice babies " et " meth babies " manquent de preuves scientifiques et ne devraient plus être utilisées.
