The initial comment period on the draft master plan for the Marr Ranch property closed on June 23rd.  A summary of comments is attached (see below).  Comments were collected from the May 21 advisory committee and public meeting, as well as from letters, phone calls and emails.  Comment focused on concern that the site not be overdeveloped and that great care is taken to determine how to provide access and interpretation in an appropriate manner.  There were mixed views on the types of trails that should be provided and whether there should be a local use parking lot off of Main Street.  Many people asked for more time for staff to consider comments and make revisions to the draft master plan before the OPRD Commission finalizes the plan. 

OPRD has decided to honor the request to push back the decision-making process.  The Commission will review the current draft plan and ask questions about it at their July 17 meeting in Baker City, but will not make a decision on the plan until their Septermber 18th meeting.  For this reason, OPRD will continue to accept comments on the draft plan and management intentions through July 14, for the Commission meeting on July 17.  You may send comments to Kathy Schutt at:

OPRD staff will be looking at design options for the trails, highway access trailhead, interpretation and local access via Main Street, in preparation for potential draft plan changes.  A revised draft master plan document will be available for public review by August 25.  The plan will be available on the OPRD web site, and will be mailed to those who do not have email.  Comments on the revised master plan will be accepted through September 15.

Both members of the Advisory Committee and general public felt that OPRD had captured the issue scoping comments well, but there was still concern that the development be sensitive to the place, its history and the neighborhood.

Ditch Company representatives and others wanted OPRD to clarify and resolve any easement related issues. The Ditch related issues included fencing to route visitors away from unsafe areas, approval of bridges over the ditches, access and cooperation on slope stabilization work, the need to accommodate new dam construction and other safety issues. The Wallowa Land Trust echoed their concerns and asked OPRD to take care in providing for maintenance access and protection from liability.

ODOT stated the NE parking lot site could likely be approved for highway access if the vegetation in the right of way is removed. No public access would be allowed at the lower gate, except for approved department service and emergency access. Parking on the highway is not recognized officially by ODOT, but is informally allowed and would likely continue to be allowed. Although the speed limit on this section of highway may need to be reduced. Any proposal for a bike lane along the highway would need grant funding and design. The same would be true of any proposed realignment of the highway to allow for better bike path alignment and/or parking.

The mayor and City of Joseph representative supported the plan in general, but asked for more time for involvement. They felt it is important to include interpretation of the ranch history, and to restore the native vegetation, potentially to support horse grazing.

The county representatives had many questions about the planning process and certain OPRD designations such as the State Heritage Site and potential conservation easement by the National Park Service. They also had questions about how park use rules are determined. It was pointed out that the county land use process would involve comment by city government. A member of the public later stated that OPRD will need to be sure that the proposals are in compliance with the county ordinances and state land use goals regarding cultural resource protection.

The National Park Service representative felt the plan was unnecessarily confusing in explaining what the many partnerships were for the site. Also that the interpretive themes are too broad and it is too soon to promote specific interpretive prescriptions. More interpretive planning is needed before decisions can be made.

Members of the three tribes stated appreciation for OPRD capturing their comments so far, but also asked that the planning decision be deferred until September to allow more time for their respective councils to weigh their concerns. They repeated that OPRD should rely on the joint agreement that calls for preservation of the site and on-going tribal involvement in planning for the management of the site. They asked for more time to avoid disrespect of tribal views. One representative asked OPRD to include the local water shed council in planning for vegetation management.

Wallowa Resources supported low key development and asked for the interpretation of geological themes, and to form a group of interested parties to look more closely at future vegetation management options.

The Wallowa Land Trust also asked for more time in the process, to make the trails more interesting, to consider allowing horses on the property, to address the use of mountain bikes up front and to interpret the ranch history.

Many of the neighbors attended the evening public meeting. Views on parking and trails were mixed, with some neighbors voicing their opinions to staff once the larger group had convened. Many neighbors are concerned about what a proposed parking lot on the site off of Main Street would do to traffic in their area. Several were outspoken about there being no parking. Others quietly asked that parking be provided to avoid parking on city streets. There seemed to be little interest in trails, as local residents use the site now without them. But did not address how OPRD should provide for travelling public access to the site. Many neighbors like to walk to the pond. Others asked that trails just find a balance between what would work for local residents and for the travelling public. Many were concerned about the structural stability of the vehicular bridge off of Main Street, keeping the pond and restoring vegetation. Several asked that the ranch history be interpreted.

Bobbie Conners, of the Umatilla Indian Reservation, spoke at the evening meeting, asking that OPRD take the time necessary to work respectfully through the issues with the tribes and their councils, to build trust and avoid mistakes by other agencies in the past. She asked that trail planning look carefully at the purpose of trails and not over-provide. Recognizing ceremonial use and the seriousness of the tribal stories is vital, she said. OPRD is inheriting a trust as the land managing agency for this site. Interpretation needs to be respectful in story and presentation, taking a low key development approach.

Letters were received from some tribal representatives, neighbors, and the National Park Service. Local residents’ letters were split regarding whether trails or limited parking off of Main Street should be provided. Opinions ranged from leaving the site alone and spending not public money on it, to providing for directed trails and parking that would fit with the site. One commenter asked for primitive camping to be allowed and access at College Street. Some had concerns about protecting cultural resources and rare plants and managing to avoid fire hazards. Most supported interpretation about a wide range of stories.

The tribes provided comments through staff representatives. Some comments came indirectly from tribal committees. All three tribes are interested in more time to discuss the specifics of how trails and interpretive media might be done on the site. The Nez Perce Fishery asked that Knight Pond be managed for trout fishing.

The National Park Service staff recommend more time for further discussions about how trails and interpretation would occur and more consultation with tribal representatives. They asked that OPRD keep an option in the plan for future trail connections into the NPS site, as may be worked out in the future with the tribes. More work is needed on theme development and little interpretive construction should occur until a full interpretive plan can be completed. Orientation at the trailhead could be done with the use of a Native American arbor and cobble rock work that would not conflict with views of the landscape. Any administrative improvements, such as storage and host site could refer to the upcoming Bear Paw plan for ideas that have been approved for a similar sensitive site.

Somehow the populace has come to an understanding that the only way to teach a lesson to the government is by pelting stone at KSRTC and BMTC buses and burning them as well. What brought them to this conclusion is only anybody's guess. How can burning buses help any cause they are protesting for?

These people just don't seem to understand that they are hurting themselves by such actions. Usually it the local buses that bear the brunt of such protests. The likely consequence is that there will be shortage of buses plying in that route from the next day. It is so ironic that the same people will then start cursing the GOVT for not providing the service.  The resources spent on repairing/replacing could have well spent on adding additional service.

Somehow, the general feeling of ownership is not imbibed into the population. People do not seem to understand that anything Govt owns is indirectly paid by them in the form of different taxes. Offcourse,  most people do not pay taxes which is a totally different issue that needs to debated. Until such ownership feeling is developed,  such behavior will continue to prevail.

Another issue is, there is no credible deterrence against such acts. How many times have we read about  people being sent to jail for burning a bus or pelting stones on Govt vehicles?  In the absence of such deterrence, there is a general feeling that anything done in the name of protests will be allowed to fade off or the matter is closed once the incidents fades off the public memory. Nobody knows what happened to all those arrested during Dr. Rajkumar's funeral procession or many such incidents. There are also news that police had made arrests after the recent violence in hubli-dharwad and haveri. But there is no official word about the status.

We also see statements by some of the politicians to take back cases against farmers who were protesting for fertilizers. Doesn't that mean that such politicians directly abet destructive behavior during such protests? Is it really good for the development of the society? What message do we give out by such statements to the general populace?

Government should strongly come out against such acts of violence both by educating the public against such acts as well as taking strong measures like enacting laws, making arrests and making sure that those arrested are sent to jail in a timely manner. If for example a person is sent jail for a year for torching a bus, then that would definitely make people think about indulging in such acts.

There are ample opportunities to set right the wrong notions in the society. The only lacking factor is the "WILL" both from the part of GOVT and the society!!!! It will be very interesting to see how the GOVT headed by  CM B.S yaddyurapp and the new Home Minister Dr. V.S Acharya  handle such cases. Also, in this age if RTI, why is the media not highlighting the issue by finding out the status of the previous cases?

This is what happens when you tell me I can't drink in public

Don't even get me started on the fascism of establishing "Animal Control" as a necessary force.  According to the Internet Center for Wildlife Damage Management, my flock and I are somehow a nuisance. As to possible signs of a goose problem, the website had this to say:

"Usually pretty obvious, flocks of geese and plenty of droppings."

Woah there, Nature-Haters, don't trip over any of my ubiquitous shit while running around your gated community warning people who never leave their houses that my molted feathers are "fouling" your "green space areas."  Those green space areas are mine now.  Just come down here and try to take them.  I'll be here, tearing up grass by its roots.  Assholes.

Last year, the court told a city in Utah that since it allows the display of a Ten Commandments monument in a public park it

must also allow followers of the Summum religion to erect a similar monument displaying the "Seven Aphorisms of Summum."

The ruling prompted an outcry by state and local officials and veterans who warn that the appeals court decision will force cities to either remove all monuments from public property or accept all privately donated monuments – including displays that might be offensive to residents.

On Monday, the US Supreme Court agreed to hear the case next fall to decide what restrictions, if any, cities and towns may enforce against the placement of private monuments on public property.

The controversy began in 2005 when the mayor of Pleasant Grove City, Utah, was contacted by the president of the Salt Lake City-based Summum church, who requested permission to erect the "seven aphorisms" monument near the city's Ten Commandments monument in Pioneer Park.

The Summum church teaches that the seven aphorisms were on the first stone tablets brought by Moses from Mount Sinai. According to the Bible, Moses smashed the first tablets. The Ten Commandments were later delivered on a second set of tablets.

When the city refused permission, the group sued. The church alleged that the city's refusal to allow a Summum monument violated First Amendment free speech protections.

A federal judge ruled for the city, but a three-judge panel of the 10th US Circuit Court of Appeals found for the church.

The case turns on what kind of speech the monument dispute implies. Does the Ten Commandments display involve private speech in an open forum – like individuals expressing their opinions in a town meeting? Or is the permanent placement of a Ten Commandments monument on public land a form of government speech that is not open to everyone?

The Ten Commandments monument was donated in 1971 by the Fraternal Order of the Eagles. The appeals court ruled that the monument was a form of private speech by the Eagles being communicated in a public forum – Pioneer Park. Because a public forum exists there, the city could not prevent others from participating by erecting their own monuments, the appeals court reasoned.

When the full 10th Circuit heard the case, it split on the issue, and the decision against the city stood.

In a dissent, Judge Michael McConnell warned of dire consequences if the appeals court decision was not overturned. "Every park in the country that has accepted a VFW memorial is now a public forum for the erection of permanent fixed monuments; they must either remove the war memorials or brace themselves for an influx of clutter," he wrote.

Judge McConnell's warning continued: "A city that accepted the donation of a statue honoring a local hero could be forced under the panel's rulings, to allow a local religious society to erect a Ten Commandments monument – or for that matter, a cross, a nativity scene, a statue of Zeus, or a Confederate flag."

In urging the high court to take up the case, Jay Sekulow of the American Center for Law and Justice says it was government speech when city officials placed the Ten Commandments monument in the park.

Accepting a monument for permanent display as the government's own property does not require accepting other monuments in the name of content – or viewpoint neutrality," Mr. Sekulow wrote in his brief on behalf of Pleasant Grove. "Nor does the government's acceptance of a donated monument require that a government park be turned into a cluttered junkyard of monuments contributed by all comers."

Lawyers for the Summum church say the public outcry is Pleasant Grove's fault. The city adopted a written policy permitting the display of privately donated monuments in public parks. Under those circumstances, the court found that donated monuments were part of a public forum. Once a public forum is established, government may not discriminate against other speakers, they say.

"Far from the radical and far-reaching decision described by [the city], the decision below is in fact narrow and limited in scope," writes Washington lawyer Pamela Harris in her brief on behalf of the church.

In a friend of the court brief, the city of Casper, Wyo., urged the high court to take up the case and reverse the 10th Circuit decision. The city said the appeals court decision had placed Casper in a "terrible dilemma."

Casper is the hometown of Matthew Shepard, a young gay man who was tied to a fence, beaten, and then left to die near Laramie, Wyo., in October 1998. The case became a national symbol of bigotry and violence against homosexuals. It also became an antigay rallying cry of Pastor Fred Phelps of the Westboro Baptist Church.

Mr. Phelps is attempting to use the 10th Circuit decision to force the city of Casper, where Mr. Shepard is interred, to erect a Matthew Shepard monument near the Ten Commandments monument in a city park.

The Phelps monument would read: "MATTHEW SHEPARD Entered Hell October 12, 1998, in Defiance of God's Warning 'Thou shalt not lie with mankind as with womankind: it is abomination.' Lev. 18:22."

"Now the city confronts a dilemma," writes Patrick Gillen of the Chicago-based Fidelis Center for Law and Policy, in his brief for the City of Casper. Does the fact that the city has a Ten Commandments monument mean that it must now incorporate Pastor Phelps's monument? he asks.

No I’m not as experienced but I do have a degree in TV News so I know some things. She was on the street, yes it may have been the street outside of their home but it is Public property. In fact she was across the street (the chick had to run across the street to attack her). Second of all maybe one of the females were very short, but it looked like a child was in the mix as well. And thirdly, I am so, so, so disappointed by the men who stood there like little punks and let these females disrespect Charmayne Brown. There was soo much bitchassness in some of those males; I could smell it through my pc. Especially the brother that got close to the fight, so he could see, and then walked away. This mess disturbs my spirit

I would write something in regards to the Females that did the attack but I seriously doubt they have the internet access or the ability to read what I wrote.

You cannot use it solely for yourself and you cannot sell it away - it is partially public property (confusing situation no?). There were others who are like you; one of them built a theme park, another planted a flower garden and others used their own creativity to generate income for themselves.

Im ersten Teil haben wir gesehen, wie die Verzeichnisstruktur innerhalb der Directory Tabelle aufgebaut ist. In diesem Teil werden wir auf spezielle Charakter in der DefaultDir Spalte eingehen und kurz die Handhabung von Verzeichnisbezeichnern innerhalb von anderen Windows Installer Tabellen oder innerhalb von Scripts besprechen.

Der Punkt „.“

Mit einem Punkt in der Spalte DefaultDir wird kein neues Verzeichnis definiert, sondern die Operation mit der Gleichsetzung auf Directory_Parent abgeschlossen.  In dieser Spalte wird also keine Operation angewendet, daher spricht man hier auch von einem NoopFolder (stammend aus  "no operation", bzw. "no-op"). Ein NoopFolder ist mit Directory_Parent identisch und die Angabe kann beispielsweise dann Sinn machen, wenn nur für das Quell- oder Zielverzeichnis eine Verzeichnisänderung erreicht werden soll (siehe nächster Absatz) und jeweils für das andere Verzeichnis nicht. Zum Teil werden NoopFolder-Einträge  auch verwendet, weil es sich bei dem Verzeichnis um einen Top Level Bezeichner handelt, welcher automatisch aufgelöst (Standardverzeichnis) oder anderweitig deklariert (public Property) wird. Oft werden aber auch nur „Redirections“ von  bestehenden Verzeichnissen auf einen neuen Key damit bewerkstelligt, weil  leere Einträge in der DefaultDir Spalte nicht erlaubt wären.

Der Doppelpunkt „:“

Mit dem Doppelpunkt werden Quell- und Zielverzeichnisse voneinander getrennt, wenn diese unterschiedlich sind. Enthält die Zeichenkette keinen Doppelpunkt, so sind Quell- und Zielverzeichnis gleich und entsprechen der in DefaultDir angegebenen Zeichenkette. Wird hingegen ein Doppelpunkt verwendet „:“, dann zielt der linke Teil vom Doppelpunkt auf das Zielverzeichnis und der rechte Teil auf das Quellverzeichnis. Somit wird auch obiges Beispiel besser verständlich, wo das Quellverzeichnis von „ZweitesDir“ einen anderen Wert ausgibt, als das entsprechende Zielverzeichnis. Es ist nämlich mit dem NoopFolder identisch, da nach dem Doppelpunkt „:“ in der Deklaration ein Punkt angewendet wurde. Im Beispiel unten werden dagegen  echte unterschiedliche Verzeichnisse definiert:

Das Pipe Zeichen „|“

Mit dem Pipe Zeichen trennt man short names (8.3) von langen Dateipfadnamen. Verwendet man short names, dann dürfen diese auch  keine Leerzeichen enthalten. Zudem sollten sie nicht den Standardregeln vom Dateisystem abgeleitet sein (PROGRA~1, MICROS~1,MYDIRE~2), sondern auf anderer Logik beruhen. Als short name deklarierte Pfade werden beispielsweise verwendet, wenn die Property SHORTFILENAMES gesetzt ist. Bei der Verwendung des Pipe Zeichens befindet sich links  davon der short name, rechts davon der lange Name.

Verwendung von Verzeichnissen in anderen Tabellen

Alle Verzeichnisbezeichner aus der Directory Tabelle können gleich verwendet werden wie jede andere Property auch. Wenn also in einer Condition eine Prüfung auf ein Verzeichnisbezeichner erfolgt, so unterscheidet sich die Verwendung nicht von der Verwendung von Windows Installer Properties. Auch Verweise in Registrykeys mittels der Brackets „[ProgramFilesFolder]“, werden durch Windows Installer anstandslos aufgelöst und mit dem richtigen Pfad ersetzt.

Der Formatted Datentyp

Directorybezeichner entsprechen dem Formatted  Datentyp. Diese Properties können innerhalb der Klammernpaare „[]“ ausgewertet werden. Wenn Windows Installer eine Zeichenfolge in der Form [property] oder [directory] ermittelt, wird der Ausdruck mit dem Inhalt der Property/des Verzeichnisses ersetzt. Verzeichnisse werden folgendermassen aufgelöst:

Der Directorybezeichner wird vollständig aufgelöst. Beispielsweise auf „C:\Program Files\MeinDir\“.

[#filekey] 
Das komplette Verzeichnis inkl. Dateinamen der Datei, welche dem Filekey aus der File Tabelle entspricht, wird aufgelöst.  Beispielsweise auf "C:\Program Files\MyDir\Datei.TXT"
Achtung: Die Auflösung erfolgt nur, wenn CostInitialize, (FileCost) und CostFinalize durch Windows Installer ausgeführt wurden. Sollte vorher auf [#filekey] zugegriffen werden, wird eine leere Zeichenfolge  "" aufgelöst.

Interessant: Sollte die Komponente als „run from Source“ markiert sein, liefert [#filekey] den Sourcepfad der Datei, ansonsten wird das Zielverzeichnis aufgelöst. Wenn die Komponente einen Aktionsstatus auf „absent“ enthält, bestimmt der Installationsstatus den Inhalt von [#filekey]. Sollte dieser auch absent oder NULL sein, so wird [#filekey] eine leere Zeichenfolge zugewiesen. Mit anderen Worten, sollte die Komponente durch die Installation nicht installiert werden (beispielsweise aufgrund dessen, weil der Level  Eintrags des Features > INSTALLLEVEL Property ist  - feature will be not installed) und fehlt diese Komponente lokal auf dem System so ergibt [#filekey] einen Leerstring "".

[$componentkey]
Diese Verwendung weist Windows Installer an, das komplette Verzeichnis der angegebenen Komponente aufzulösen. Auch hier erfolgt eine Auflösung nur nach den entsprechenden Actions CostInitialize, (FileCost) und CostFinalize. Sollte die Komponente als „run from Source“ markiert sein, liefert [$componentkey] den Sourcepfad der Datei, ansonsten wird das Zielverzeichnis aufgelöst.
Die Auswertung bezieht sich auf den Aktionsstatus der angegebenen Komponente.  Steht dieser auf Local oder Source, wird entsprechend das Quell- oder Zielverzeichnis aufgelöst. Befindet sich die Zeichenfolge [$componentkey] in der Value Spalte der Registry Tabelle, wird zusätzlich der Anforderungsstatus überprüft.

[!filekey]
Windows Installer löst das komplette Verzeichnis inkl. Dateinamen eines Filekeys als short name auf. Diese Verwendung ist nur in der Value Spalte der Registry - und IniFile Tabelle gültig. Ausserhalb dieser Tabellen ersetzt Windows Installer diese Zeichenfolge mit der [#filekey] Repräsentation.

Folgende Beispiele verdeutlichen die Verwendung von [$component] und [#filekey]:

Bevor der eine oder andere schon an die Umsetzung einer rekursiven Funktion zum Ermitteln eines Zielverzeichnisses einer Komponente geht, möchte ich eine andere, weit einfachere Möglichkeit aufzeigen, um auf den kompletten Verzeichnisnamen in externen MSI Dateien mittels dem Windows Installer Automationsmodell zugreifen zu können. Über dass Session Objekt können mittels
Session.TargetPath oder Session.SourcePath (Achtung: oSession.DoAction("ResolveSource") zuerst ausführen)  Quell- oder Zielverzeichnisse von Directory-Bezeichnern ermittelt werden. Noch einfacher und globaler einsetzbar, geht es mit der Session.FormatRecord Methode, welche  einfach den Formatted Datentyp auswertet. Im unten dokumentierten Beispiel gehen wir bei den Vorbereitungen noch einen Schritt weiter, als im letzten Kapitel, indem wir neben den FileCosting Actions zusätzlich AppSearch ausführen. Dies hat den Vorteil, dass über  AppSearch  zu ermittelnde Verzeichnisse ebenfalls ausgewertet werden.

Hier ein einfaches Beispiel mittels dem Windows Installer Automationsmodell:

Viele, die schon einmal einen Blick in die Directory Tabelle geworfen haben, werden sich über deren Aufbau gewundert haben. Meistens scheut man es, Verzeichnisse zur Kontrolle  in Orca „per Hand“ aufzulösen und schaut daher lieber mal in den Editoren der Auringtools nach, wie ein entsprechendes Verzeichnis nun ausgeschrieben aussehen mag. Es gibt aber Situationen, wo wir uns über den Aufbau im Klaren sein müssen oder wo wir per Script den vollständigen Verzeichnisnamen benötigen. Für diese  Zwecke und für das allgemeine Verständnis sind nachfolgende Zeilen gedacht:

In einer Windows Installer Datenbank finden wir Verzeichnisangaben in der Directory Tabelle. Alle Verzeichnisreferenzen aller Komponenten verweisen auf  den Primary Key dieser Directory Tabelle und sind an sich Windows Installer Properties. Diese Tabelle wird schliesslich während des File Costing Prozesses durch Windows Installer ausgewertet.

Der Aufbau der Directory Tabelle

Die Directory Tabelle enthält drei Spalten,  Directory, Directory_Parent und DefaultDir. Die Spalte Directory ist zugleich der Primary Key der Tabelle, d.h auch, dass dieser einen eindeutigen und einmalig vorkommenden Namen enthalten muss. Man sieht es bereits am Namen der Spalte Directory an, dass diese Spalte der Primary Key der Tabelle ist, da die Namen der Tabelle (Directory) und der Spalte (Directory) identisch sind.  Bei Windows Installer Standard Tabellen, wo nur ein Primary Key vorkommt, wird oft in der Schlüsselspalte der selbe Name verwendet.
Eine Verzeichnisstruktur setzt sich aus dem Verweis auf einen Key in Directory_Parent und dem Unterverzeichnis (DefaultDir) zusammen. Das Auflösen der Directory_Parent erfolgt hierbei in mehreren Schritten maximal bis zu einem der Standardverzeichnisse, bis zu TARGETDIR  (bzw. SourceDir) oder bis zu einem als public Property deklarierten Directory, welches durch AppSearch, CustomAction Typ 35 oder 51, durch die Commandline  oder in der Property Tabelle definiert wurde.  Abgeschlossen wird jede Verzeichnisangabe schliesslich durch ein Backslash „\“ am Ende der Zeichenkette.

Beispiel:

Top Level Verzeichnisse

Als Top Level Verzeichnisse werden hier Verzeichnisse benannt, die nicht weiter durch die Standardmechanismen aufgelöst werden müssen, da sie selbst durch Windows Installer während der Installation bestimmt werden. Diese Verzeichnisse bilden die "Root", aber müssen sich aber nicht auf ein Root-Verzeichnis beschränken. Das Verzeichnis ProgramFilesFolder, welches auf "C:\Program Files" zeigen könnte, ist demnach beispielsweise ein Top Level Verzeichnis.

Die Auflösung der Top Level Verzeichnisse  erfolgt durch Windows Installer auf verschiedene Art und Weise. Standardverzeichnisse werden wie die komplette  Auswertung der Directory Tabelle auch innerhalb der Action CostFinalize aufgelöst. Diese werden dort aber durch die API Funktion SHGetFolderPath() ermittelt. Das Top Level Standardverzeichnis ProgramFilesFolder wird dabei beispielsweise mit der Zeichenkette “C:\Program Files\” gleichgesetzt und das LocalAppData Verzeichnis bekäme unter Windows Vista für eine Installation in meinem Kontext beispielsweise den Wert „C:\Users\oberlind\AppData\Local“.
In der Directory Tabelle verwendete public Properties werden hingegen durch die Action AppSearch, durch die Deklaration in der Property Tabelle, durch CustomActions Typ 35 oder 51, durch die Commandline oder durch das SetTargetPath() ControlEvent (bei full UI) deklariert. Für jedes  verwendete  Top Level Verzeichnis muss sich ein gültiger Eintrag in der Directory Tabelle befinden. Diese Deklaration wird aber während der Ausführung der MSI mit den „echten“ Werten überschrieben.

Beispiel mit Top Level Verzeichnissen TARGETDIR, ProgramFilesFolder und MYDATS:

Man beachte, dass MYDATS automatisch ein Backslash angehängt wurde. Hätte man im Beispiel auf ein Verzeichnis mit Leerzeichen verweisen wollen, bspl. MYDAT=C:\Program Files\ProgramDat\Root, so wäre die Angabe von Anführungszeichen in der Commandline erforderlich gewesen:MYDATS=“C:\Program Files\ProgramDat\Root“.

TARGETDIR, SourceDir und ROOTDRIVE

Das Top Level Verzeichnis TARGETDIR bestimmt das Rootverzeichnis der Installation. TARGETDIR muss sich in der Directory Tabelle befinden, ansonsten erhält man Fehlermeldungen wie diese: „Root directory property undefined“. Die Deklaration muss hierbei folgenden Aufbau haben:

Falls der Inhalt von TARGETDIR bei der Installation nicht definiert wurde (beispielsweise über die Commandline), wird die Property ROOTDRIVE aufgelöst, um den Pfad zu ermitteln. Sollte auch ROOTDRIVE weder in der Property Tabelle noch über die Commandline angegeben worden sein, setzt Windows Installer bei einer Administrativinstallation diese Property auf das erste verfügbare und beschreibbare Netzwerklaufwerk. Bei einer Installation wird diese Property hingegen auf das Laufwerk mit dem grössten verfügbaren Speicherplatz gesetzt. Das sind die Gründe, warum im Deployment die Verwendung auf ROOTDRIVE=C:\ in der Property Tabelle empfohlen ist. Nichtbeachten dieser Regel kann dazu führen, dass eine Installation auf dem einen PC auf das lokale Laufwerk C:\ erfolgt, bei einem benachbarten  Gerät hingegen auf Laufwerk D:\, wenn dort beispielsweise eine zweite Disk mit mehr Platz verfügbar ist.
Bei einer Administrativinstallation wird die Angabe von TARGETDIR in der Commandline empfohlen, da dadurch das Zielverzeichnis angegeben wird, wohin die Administrativinstallation erfolgen soll:

Msiexec.exe /a mymsi.msi TARGETDIR=H:\AdminP

Bei der Property SourceDir müssen keine expliziten Deklarationen in der Directory Tabelle erfolgen. SourceDir repräsentiert denn auch das Quellverzeichnis. Externe Cabinettdateien oder extern und unkomprimiert vorliegende Sourcedaten werden bei einer Installation oder Reparatur in diesem Verzeichnis gesucht. Auch CustomActions können aus diesem Verzeichnis ausgeführt werden oder auf dieses Verzeichnis über MsiGetProperty zugreifen. Die SourceDir Property wird über die Action ResolveSource, welche nach CostInitialize einzuordnen ist, initialisiert.

Tip: Möchten Sie alle Zugriffe bei einer Deinstallation auf das Installationsverzeichnis und allfällige SOURCELIST Verzeichnisse unterbinden, können Sie dies mit der Condition NOT REMOVE=“ALL“ bei ResolveSource in der InstallExecuteSequence Tabelle steuern.

Betrachtungen im Installationsprozess

Die Verzeichniseinträge werden während des Installationsprozesses in der Regel sowohl im Client-, als auch im Serverprozess ermittelt. Dabei werden die Verzeichniseinträge der Directory Tabelle während des File Costing Prozesses durch den DirectoryManager über das Installationsmodul des entsprechenden Prozesses ausgewertet.
Während dieser Phase werden die Directorybezeichner entsprechenden Properties zugewiesen. In einer Protokolldatei mit Verboseinformationen findet man daher nach der Ausführung von CostFinalize auch ein Dump dieser ermittelten Verzeichnisse.

சேலம், பிப். 16: தருமபுரி அருகே கோவை வேளாண் பல்கலைக் கழக மாணவியர் மூன்று பேர் பஸ்ஸில் உயிரோடு எரிக்கப்பட்ட சம்பவம் பரபரப்பை ஏற்படுத்தியது. இச்சம்பவம் தொடர்பாக அதிமுக-வினர் மீது வழக்குத் தொடரப்பட்டது. இச்சம்பவம் குறித்த விவரம் வருமாறு:

2000-ம் ஆண்டு கோவை வேளாண் பல்கலைக்கழக மாணவர்கள் 54 பேர், மாணவிகள், பேராசிரியைகள் உள்பட 50 பேர் தனித்தனி பஸ்களில் 12 நாள்கள் கல்விச்சுற்றுலா சென்றனர்.

பல ஊர்களுக்குச் சென்ற அவர்கள், தருமபுரி மாவட்டம் பையூரில் உள்ள வேளாண் ஆராய்ச்சி மையத்துக்கு பிப்.2-ம் தேதி வந்தனர். அன்றோடு சுற்றுலா முடிந்ததால், ஏற்காடு செல்லத் திட்டமிட்டிருந்தனர்.

மாணவிகள் வந்திருந்த பஸ், ஏற்காடு மலைப்பாதையில் செல்ல இயலாது என்பதால், ஒகேனக்கல் செல்வதென்று முடிவு செய்யப்பட்டது.

பிப்.2-ம் தேதி காலை பல்கலைக்கழக பஸ்ஸில் மாணவிகள் மட்டும் ஒகேனக்கல் சென்று கொண்டிருந்தனர்.

வழியில் தருமபுரியை அடுத்த இலங்கியம்பட்டியில் வேளாண் பல்கலைக்கழக மாணவிகள் வந்த பஸ், அதிமுகவினரால் மறிக்கப்பட்டது.

கொடைக்கானல் ஓட்டல் வழக்கில் முன்னாள் முதல்வர் ஜெயலலிதாவுக்கு ஓராண்டு சிறை தண்டனை விதிக்கப்பட்டதை எதிர்த்து, ஆங்காங்கு போராட்டத்தில் ஈடுபட்ட அதிமுகவினர் இந்த பஸ்ûஸ வழி மறித்தனர்.

அதிலிருந்த மாணவிகள் அனைவரும் இறங்குவதற்குள், பெட்ரோல் ஊற்றி பஸ்ஸþக்குத் தீயிடப்பட்டது. மளமளவென்று பற்றி எரிந்த பஸ்ஸில் சிக்கிக் கொண்ட மாணவிகள் கோகிலவாணி (19), ஹேமலதா (19), காயத்ரி (19) ஆகியோர் உடல் கருகி பலியானார்கள்.

இச்சம்பவத்தில் 18 மாணவிகள் தீக்காயங்களுடன் தப்பினர்.

தமிழகத்தையே உலுக்கிய இச்சம்பவம் குறித்து சிபிசிஐடி போலீஸ் விசாரணைக்கு உத்தரவிடப்பட்டது.

இதுகுறித்து நடந்த விசாரணையில், சம்பவத்தன்று மோட்டார் சைக்கிளில் வந்த மூவர் பஸ்ஸþக்குத் தீயிட்டனர். அவர்களை நேரடியாகப் பார்த்தால் அடையாளம் காட்ட முடியும் என்று மாணவிகள் தெரிவித்தனர்.

அவர்கள் கூறிய தகவல்கள் அடிப்படையில், தீவிர விசாரணை மேற்கொண்ட போலீஸôர், மோட்டார் சைக்கிளில் வந்தது அதிமுகவைச் சேர்ந்த புளியம்பட்டி பஞ்சாயத்துத் தலைவர் முனியப்பன் எனக் கண்டறிந்தனர். இதையொட்டி சேலத்தில் அவரை போலீஸôர் கைது செய்தனர்.

மோட்டார் சைக்கிளில் தருமபுரி நகர் அதிமுக கிளைச் செயலாளர் நெடு என்ற நெடுஞ்செழியன், எம்ஜிஆர் இளைஞர் அணி நகரத் துணைத்தலைவர் மாது என்ற ரவீந்திரன் ஆகியோர் பிளாஸ்டிக் கேனில் பெட்ரோல் வாங்கிக் கொண்டு, இலங்கியம்பட்டி நோக்கிச் சென்றனர்.

அப்போது வழியில் பாரதிபுரம் என்ற இடத்தில் நின்று கொண்டிருந்த கல்லூரி பஸ்ஸþக்கு முன்பு மோட்டார் சைக்கிளை நிறுத்தி விட்டு, பஸ்ஸþக்குள் பெட்ரோலை ஊற்றி தீயிட்டதாகவும் விசாரணையில் முனியப்பன் தெரிவித்தார்.

இதையொட்டி 2000-ம் ஆண்டு பிப்ரவரி 11-ம் தேதி நெடு என்ற நெடுஞ்செழியன், மாது என்ற ரவீந்திரன் ஆகியோரை சிபிசிஐடி போலீஸôர் கைது செய்தனர்.

இலக்கியம்பட்டியில் மறியலில் ஈடுபட்ட தருமபுரி ஒன்றிய அதிமுக செயலாளர் டி.கே.ராஜேந்திரன் உள்பட 28 பேர் இவ்வழக்கில் கைது செய்யப்பட்டனர்.

தருமபுரி மாஜில்திரேட் நீதிமன்றத்தில் 2000-ம் ஆண்டு ஏப்ரல் 28-ம் தேதி சிபிசிஐடி போலீஸôர் குற்றப்பத்திரிகை தாக்கல் செய்தனர். இதில் 386 பேர் சாட்சிகளாகச் சேர்க்கப்பட்டிருந்தனர்.

தருமபுரி மாஜிஸ்திரேட் நீதிமன்றத்தில் மே 2-ம் தேதி இவ்வழக்கு விசாரணை நடைபெற்றது. அங்கிருந்து ஜூலை 24-ம் தேதி கிருஷ்ணகிரி செசன்சு நீதிமன்றத்துக்கு இவ்வழக்கு மாற்றப்பட்டது.

அங்கு 2001-ம் ஆண்டு நவம்பர் மாதம் 5-ம் தேதி இவ்வழக்கு விசாரணை தொடங்கியது.

அப்போது அதிமுக ஆட்சி நடைபெற்றது. பஸ் எரிப்பு குறித்து புகார் செய்த கிராம நிர்வாக அதிகாரி உள்பட 20 பேர் பிறழ் சாட்சிகளாக மாறினர்.

பஸ் எரிப்பில் பலியான கோகிலவாணியின் தந்தை வீராசாமி இந்த வழக்கை கோவை நீதிமன்றத்துக்கு மாற்றக்கோரி, சென்னை உயர்நீதிமன்றத்தில் மனு தாக்கல் செய்தார்.

இதை விசாரித்த நீதிபதி கனகராஜ், இவ்வழக்கை சேலம் முதலாவது கூடுதல் செசன்சு நீதிமன்றத்துக்கு மாற்ற உத்தரவிட்டார்.

அரசு வழக்கறிஞராக சீனிவாசனை நியமித்து, 2003-ம் ஆண்டு ஆகஸ்ட் 22-ல் உயர்நீதிமன்ற நீதிபதி உத்தரவிட்டார்.

இச்சம்பவம் தொடர்பாக குற்றம் சாட்டப்பட்டோரில், அதிமுக நிர்வாகிகள் நெடு என்ற நெடுஞ்செழியன், மாது, முனியப்பன் ஆகிய மூவர் கொலைக் குற்றவாளிகளாக அறிவிக்கப்பட்டனர்.

மேலும் 25 அதிமுகவினர் மீதான குற்றச்சாட்டு நிரூபணமானது என்று நீதிபதி கிருஷ்ணராஜா தமது தீர்ப்பில் குறிப்பிட்டார்.

இந்த வழக்கில், குற்றவாளிகள் யார் யாரென்று தமது தீர்ப்பில் குறிப்பிட்டார் நீதிபதி.

அவர்களுக்கு என்னென்ன தண்டனை என்பது குறித்து வெள்ளிக்கிழமை அறிவிக்கப்படும் எனவும் நீதிபதி தெரிவித்தார்.

இதில் குற்றம் சாட்டப்பட்டிருந்த பழனிசாமி, மாதேஷ் ஆகியோர் விடுதலை செய்யப்பட்டனர்.

சேலம் நீதிமன்றத்தில் கடும் போலீஸ் பாதுகாப்புக்கிடையே இவ்வழக்கில் தீர்ப்பு அளிக்கப்பட்டது.

நீதிமன்றத்துக்கு வியாழக்கிழமை காலை 10.30 மணிக்கு வந்த நீதிபதி கிருஷ்ணராஜா, முதலில் வேறு வழக்குகள் குறித்து விசாரித்தார்.

இதையடுத்து பகல் 10.53 மணிக்கு தருமபுரி பஸ் எரிப்பு வழக்கு குறித்து தீர்ப்பளித்தார்.

இவ்வழக்கில் குற்றம் சாட்டப்பட்ட 31 பேரில், செல்லக்குட்டி என்பவர் ஏற்கெனவே இறந்து விட்டார். நீதிமன்றத்தில் மற்ற 30 பேரும் ஆஜராகியிருந்தனர்.

அவர்களில் எஸ்.பழனிசாமி, மாதேஷ் ஆகியோர் வழக்கிலிருந்து விடுவிக்கப்படுவதாக நீதிபதி அறிவித்தார்.

இவ்வழக்கில் மற்றவர்கள் மீதான குற்றச்சாட்டு நீருபிக்கப்பட்டுள்ளது என்று தெரிவித்தார் நீதிபதி.

அரசுத் தரப்பில் 22 குற்றச்சாட்டுகள் கூறப்பட்டிருந்தன. இதில் 4 குற்றச்சாட்டுகள் நிரூபிக்கப்படவில்லை. மற்ற குற்றச்சாட்டுகள் உறுதி செய்யப்பட்டன.

குற்றம் சாட்டப்பட்ட ஒவ்வொருவரின் பெயரைக் குறிப்பிட்டு, அவர்கள் மீதான குற்ற விவரத்தைப் படித்த நீதிபதி கிருஷ்ணராஜா, அது நிரூபிக்கப்பட்டுள்ளது என்றார்.

ஒவ்வொருவர் மீதும் வெவ்வேறு பிரிவுகள் கீழ் குற்றம் சாட்டப்பட்டுள்ளது. இதன் அடிப்படையில் தண்டனை விதிப்பதாகவும், தங்கள் கருத்தைக் கூறும்படியும் ஒவ்வொருவரிடமும் கேட்டார் நீதிபதி. அதற்கு குற்றம் சாட்டப்பட்ட அனைவரும் தங்களுக்குக் குறைந்தபட்ச தண்டனை வழங்கும்படி கேட்டுக் கொண்டனர்.

கொலைக் குற்றம் சாட்டப்பட்ட மாது, முனியப்பன் ஆகியோர், தாங்கள் எந்தத் தவறும் செய்யவில்லை என்றனர்.

அப்போது குறுக்கிட்டு பேசிய அரசு வழக்கறிஞர் சீனிவாசன், குற்றம் சாட்டப்பட்ட அனைவருக்கும் அதிகபட்ச தண்டனை வழங்க வேண்டும் என கூறினார்.

அதிமுக நிர்வாகிகள் நெடு என்ற நெடுஞ்செழியன், மாது, முனியப்பன் ஆகியோரை கொலைக் குற்றவாளிகள் என்று தீர்ப்பளித்தார் நீதிபதி.

இதையொட்டி அவர்களுக்கு அளிக்கப்பட்டிருந்த ஜாமீன் ரத்து செய்யப்பட்டது. மற்றவர்கள் நீதிமன்றத்தில் வெள்ளிக்கிழமை ஆஜராக வேண்டும் என உத்தரவிட்டார் நீதிபதி.

தர்மபுரி பஸ் எரிப்பு வழக்கு: 3 பேருக்கு தூக்கு தண்டனை; 25 பேருக்கு தலா 7 ஆண்டு ஜெயில்

சேலம், பிப். 16-

கொடைக்கானல் ஓட்டல் வழக்கில் அ.தி.மு.க. பொதுச் செயலாளர் ஜெயலலிதாவுக்கு தண்டனை விதிக்கப் பட்டதை கண்டித்து தமிழ்நாடு முழுவதும் அ.தி.மு.க.வினர் மறியல் போராட்டத்தில் ஈடுபட்டனர்.

அப்போது தர்மபுரி இலக்கி யம்பட்டியில் கோவை வேளாண் கல்லூரி மாணவி கள் வந்த பஸ் எரிக்கப்பட்டது. இதில் மாணவிகள் கோகில வாணி, ஹேமலதா, காயத்ரி ஆகியோர் உயிரோடு எரிந்து பலியானார்கள்.

இது தொடர்பாக அ.தி.மு.க. நிர்வாகிகள், தொண்டர்கள் 31 பேர் கைது செய்யப்பட்டு வழக்கு தொடரப்பட்டது. வழக்கு விசாரணை சேலம் செசன்சு கோர்ட்டில் நடந்தது.

நேற்று இந்த வழக்கில் தீர்ப்பு வழங்கப்பட்டது. அப்போது நிர்வாகிகள் நெடுஞ்செழியன், மாது, முனியப்பன் ஆகிய 3 பேர் கொலை குற்ற வாளிகள் என்று நீதிபதி கிருஷ்ணராஜா தீர்ப்பு கூறினார்.

மாதேஷ், பழனிச்சாமி விடுதலை செய்யப்பட்டனர். மற்ற 25 பேர் மீது சட்ட விரோதமாக கூடுதல், பொது சொத்தை சேதப்படுத்துதல் ஆகிய பிரிவுகளில் குற்றங்கள் நிரூபணமானதாக நீதிபதி கூறினார்.

தண்டனை விவரம் இன்று அறிவிப்பதாக நீதிபதி கூறினார்.

தண்டனை விவரத்தை நீதிபதி கிருஷ்ணராஜா இன்று பகல் 10.45 மணிக்கு அறிவித்தார்.

கொலை குற்றம் நிரூபிக் கப்பட்ட நெடுஞ்செழியன், மாது, முனியப்பன் ஆகிய 3 பேருக்கும் தூக்கு தண்டனை விதித்து தீர்ப்பு கூறினார். மற்ற 25 பேருக்கும் தலா 7 ஆண்டுகள் ஜெயில் தண்டனை விதிக்கப்பட்டது.

நீதிபதி கிருஷ்ணராஜா வழங்கிய தண்டனை விவரம் வருமாறு:-

கொலை குற்றவாளிகளாக அறிவிக்கப்பட்ட நெடு என்ற நெடுஞ்செழியன், மாது என்ற ரவீந்திரன், முனியப்பன் ஆகிய 3 பேருக்கும் அதிகபட்சமாக தூக்கு தண்டனை விதிக்கப்பட்டது.

மேலும் 46 பேரை கொல்ல முயன்றதாக 307-வது பிரி வின்கீழ் 7 ஆண்டு சிறை தண்டனை மற்றும் ரூ. 46 ஆயிரம் அபராதம் விதிக்கப் படுகிறது.

இது தவிர சொத்து சேதப் படுத்துதல் உள்ளிட்ட 7 பிரிவுகளில் குற்றம் நிரூபிக்கப் பட்டுள்ளதால் 7 ஆண்டு 3 மாதம் ஜெயில் தண்டனையும், ரூ. 13 ஆயிரம் அபராதமும் இவர்களுக்கு பொருந்தும்.

டி.கே.ராஜேந்திரன் உள்பட மற்ற 25 பேருக்கும் பொது சொத்துக்கு சேதம் விளை வித்தல், சாலை மறியல், பஸ் கண்ணாடிகளை உடைத்து எறிதல், வாகனங்களையும், மனித நடமாட்டத்தையும் தடுத்தல், சட்ட விரோதமாக கும்பலாக கூடுதல், உயிர் சேதம் விளைவிக்கும் எண்ணத் துடன் சட்டவிரோத கும்பலு டன் கூடி கலகம் விளை வித்தல், தமிழ்நாடு சொத்து பாதுகாப்பு சட்டம் உள்ளிட்ட 7 பிரிவுகளில் குற்றம் நிரூபிக் கப்பட்டுள்ளதால் 25 பேருக்கும் தலா 7 ஆண்டு 3 மாதம் ஜெயில் தண்டனையும், தலா ரூ. 13 ஆயிரம் அபராதமும் விதிக்கப்பட்டது.

இதில் மணி என்ற மெம்பர் மணி என்பவர் பயங்கர ஆயுதங்களால் பஸ்சை உடைத்ததாக அவருக்கு கூடுதல் 6 மாதம் (அதாவது 7 ஆண்டு 9 மாதம்) ஜெயில் தண்டனை விதிக்கப்பட்டது.

"கெஞ்சிய மாணவிகளை கொளுத்தியது அரிதிலும் அரிய குற்றம்'

சேலம், பிப். 17: "உயிர் தப்பிக்க கையெடுத்துக் கும்பிட்டுக் கெஞ்சிய மாணவிகளை பஸ்ஸிலிருந்து இறங்கவிடாமல் தீயிட்டுக் கொளுத்திய கொடுஞ்செயல் அரிதிலும் அரிதான சம்பவமாகும்' என்று சேலம் மாவட்ட முதலாவது கூடுதல் அமர்வு நீதிபதி கிருஷ்ணராஜா தமது தீர்ப்பில் குறிப்பிட்டுள்ளார்.

"குற்றம் நிரூபணமானோருக்கு ஆயுள் தண்டனை விதிப்பது சட்டரீதியான நடவடிக்கையாகும்; அதேசமயத்தில் தூக்குத் தண்டனை விதிப்பது விதிவிலக்காகும்' என்றும் அவர் தெரிவித்துள்ளார்.

தருமபுரியில் வேளாண் பல்கலைக்கழக மாணவியர் எரிப்பு தொடர்பான வழக்கில் 3 பேருக்கு தூக்குத் தண்டனை விதித்து அவர் வெள்ளிக்கிழமை தீர்ப்பளித்தார். 180 பக்கங்கள் கொண்ட அவரது தீர்ப்பில் குறிப்பிட்டுள்ள முக்கிய விவரங்கள் வருமாறு:

தருமபுரி அருகேயுள்ள இலக்கியம்பட்டியில் நடந்த பஸ் எரிப்புச் சம்பவத்தில் 3 மாணவிகள் உயிரோடு கொளுத்தப்பட்டுள்ளனர்.

அன்று நடந்த சம்பவம் சமுதாயத்தை அதிர்ச்சிக்கு உள்ளாக்கியுள்ளது. இத்தகைய செயலில் ஈடுபட்டோர் "திருத்த முடியாத குற்றவாளிகள்' எனக் கருதும் நிலையை ஏற்படுத்தியுள்ளது.

"பஸ் கதவை மூடுங்கடா; அனைவரையும் கொளுத்துங்கடா' என சம்பவ இடத்தில் சப்தமிட்டதும் அவர்களது நோக்கத்தை வெளிப்படுத்தியுள்ளது.

இத்தகைய செயல் ஏற்க முடியாதது. ஏனென்றால் அங்கு நடந்த சம்பவத்தைப் பொதுமக்களே நேரில் பார்த்து அதிர்ச்சி அடைந்துள்ளனர்.

இந்த கொடுஞ்செயலில் தங்கள் பிள்ளைகளைப் பறிகொடுத்த பெற்றோரது மனநிலை, தீயில் காயமடைந்த மாணவிகளின் நிலையைக் கருதி, நடந்த சம்பவத்தை கடும் குற்றச் செயலாகக் கருதி தீர்ப்பளிக்க வேண்டியுள்ளது.

தருமபுரியில் அன்று நடந்த சம்பவம் சமுதாயத்தில் யாராலும் ஏற்க முடியாதது; மனிதாபிமானமற்ற முறையில் அப்பாவி மாணவிகள் மூவரைக் கொடூரமான முறையில் கொலை செய்தது அதிகபட்ச தண்டனை விதிக்க வேண்டிய குற்றமாகும் என்று நீதிபதி கிருஷ்ணராஜா தமது தீர்ப்பில் தெரிவித்துள்ளார்.

3 மாணவிகள் எரிப்பு வழக்கு: அடையாளம் காண உதவிய கேசட்டுகள்

சேலம், பிப். 17: தருமபுரி அருகே பஸ்ஸில் மாணவிகள் உயிரோடு எரிக்கப்பட்ட வழக்கில் குற்றவாளிகளை அடையாளம் காண வழிவகுத்தவை தெளிவான- வலுவான விசாரணை, சாட்சியங்கள், ஆதாரமாய் அமைந்த தொலைக்காட்சி நிறுவன விடியோ கேசட்டுகள், புகைப்படங்கள்தான் என்று இவ்வழக்கில் ஆஜரான அரசு வழக்கறிஞர் சீனிவாசன் கூறினார்.

சேலம் நீதிமன்றத்தில் கொலைக் குற்றவாளிகளுக்கு தூக்குத் தண்டனை, மற்றவர்களுக்கு தண்டனை அறிவிக்கப்பட்ட பின் நிருபர்களிடம் அவர் கூறியதாவது:

மாணவிகள் எரிப்பு சம்பவம் தொடர்பான குற்றவாளிகளுக்கு அதிகபட்ச தண்டனை விதிக்க வேண்டும் என நீதிமன்றத்தில் வலியுறுத்தினேன். அதற்கேற்ப இத்தீர்ப்பு அமைந்துள்ளது.

பாதிக்கப்பட்டோர் சார்பில் சட்டரீதியாக நடவடிக்கை எடுக்கப்பட்டது. குறிப்பாக, பலியான கோகிலவாணியின் தந்தை வீராசாமி, இவ்வழக்கு விசாரணையை வேறு நீதிமன்றத்துக்கு மாற்றக்கோரி உயர் நீதிமன்றத்தில் மனுச் செய்ததே, இவ்வழக்கின் திருப்புமுனையாகும்.

இவ்வாறு இந்த வழக்கை வேறு மாவட்டத்துக்கு மாற்றியதே, இதன் விசாரணையை சரியான முறையில் தொடர வழிவகுத்தது.

இவ்வழக்கில் சாட்சியமளித்தோர் பங்கு குறிப்பிடத்தக்கது. அதுவும் குற்றவாளிகளுக்கு தண்டனை கிடைக்க ஆதாரமாய் அமைந்துள்ளது என்றார் சீனிவாசன்.

அச்சுறுத்தல்: இவ்வழக்கில் ஆஜரானவுடன் எனக்கும் அச்சுறுத்தல்கள் வந்தன. என் வீட்டு மாடியில் துப்பாக்கியால் சுடப்பட்டது. அப்போது அதை நான் வெளியில் சொல்லவில்லை. வழக்கு விசாரணை பாதிப்பின்றி நடைபெற வேண்டும் என அமைதியாக இருந்துவிட்டேன் என்றும் சீனிவாசன் குறிப்பிட்டார்.

நிலத்தின் உரிமையாளருக்கு சாதகமாக நீதிமன்றம் ஒன்று உத்தரவு பிறப்பித்த நிலையில் அந்த நிலத்தை கையகப்படுத்தும் நோக்கில் அரசு அறிவிக்கை வெளியிட்டால் அதை தவறான நோக்கத்தில் வெளியிட்டதாக கருத முடியாது என்று உச்ச நீதிமன்ற நீதிபதிகள் சி.கே.தாக்கர், லோகேஷ்வர் சிங் பென்டா ஆகியோர் அடங்கிய பெஞ்ச் தீர்ப்பு அளித்துள்ளது.

கர்நாடக உயர் நீதிமன்ற தனி நீதிபதி மற்றும் டிவிஷன் பெஞ்ச் ஆகியவை பிறப்பித்த உத்தரவை ரத்து செய்து உச்ச நீதிமன்ற பெஞ்ச் மேற்சொன்ன தீர்ப்பை பிறப்பித்தது.

உரிமையாளருக்கு ஆதரவாக சிவில் கோர்ட் ஒன்று தீர்ப்பு பிறப்பித்த பிறகு அந்த நிலத்தை கையகம் செய்யலாம் என்று அறிவிக்கை பிறப்பிப்பது சட்ட விரோதமானது என்று தனி நீதிபதியும் உயர்நீதிமன்ற டிவிஷன் பெஞ்ச்சும் தீர்ப்பு பிறப்பித்திருந்தன.

கர்நாடக மாநிலம் தொடர்பானது இந்த வழக்கு. அரசு நிறுவனமான எச்எம்டி, கடிகார தொழிற்சாலை அமைப்பதற்காக தேவராயபட்டினத்தில் பல்வேறு சர்வே எண்கள் கொண்ட 120 ஏக்கர் நிலத்தை கர்நாடக தொழில் பகுதி மேம்பாட்டு வாரியம் கையகப்படுத்தியது.

இந்த 120 ஏக்கரில் சுமார் ஒரு ஏக்கர் நிலம் முத்தப்பா குடும்பத்துக்குச் சொந்தமானதாகும். இது தொடர்பாக முத்தப்பா என்பவர் பிரச்சினை எழுப்பியிருந்தார்.

எமது குடும்பத்தைச் சேர்ந்த நிலம் கையகப்படுத்தப்பட்ட படி விட்டுக் கொடுத்தோம். ஆனால் அதற்கு மேலாக சிறிது நிலத்தை எச்.எம்.டி ஆக்கிரமித்துள்ளது. இதிலிருந்து காலி செய்ய மாட்டோம் என்று முறையிட்டார் முத்தப்பா.

இது தொடர்பான வழக்கை விசாரித்த சிவில் கோர்ட், எச்எம்டி ஆக்கிரமித்த நிலத்தை உரிமையாளரிடமே திரும்ப ஒப்படைக்க வேண்டும் என்று உத்தரவிட்டது.

இதை எதிர்த்து எச்எம்டி அப்பீல் செய்தபோதும் அது டிஸ்மிஸ் செய்யப்பட்டது.

எனினும் சிவில் கோர்ட் உத்தரவை எச்எம்டி ஏற்கவில்லை. அதற்கு பதிலாக மாநில அரசை அணுகி அந்த நிலம் தொடர்பாக புதிய அறிவிக்கையை பிறப்பிக்கும்படி கோரியது. இதனால் உயர்நீதிமன்றத்தை நில உரிமையாளர் அணுகினார். இதையடுத்து தனி நீதிபதியும், டிவிஷன் பெஞ்சும் நிலத்தை கையகப்படுத்தி அரசு வெளியிட்ட அறிவிக்கை செல்லாது என்று தீர்ப்பு வெளியிட்டனர். இதையடுத்து உச்ச நீதிமன்றத்தில் அப்பீல் செய்தது எச்எம்டி.
